Fly ROAS AI · Terms of service

At a glance

  • You stay the captain: in “Ask me first” mode nothing launches without your OK, and Autopilot never sets budgets above your caps.
  • Meta bills your ad spend directly. We bill only your plan and any credit packs.
  • Charges are non-refundable — cancel anytime to stop future renewals.
  • You own your content and the ads you create with it.

01Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and Fly ROAS AI (“we”, “us”). They govern your use of the Fly ROAS AI website at www.flyroas.com, the web app and related services (together, the “Service”).

By creating an account, starting a test flight or otherwise using the Service, you agree to these Terms, our Privacy policy and our Refund policy. If you use the Service on behalf of a business, you confirm you have authority to bind that business, and “you” includes it. If you don’t agree, please don’t use the Service.

02Eligibility

You must be at least 18 years old and able to form a binding contract. The Service is built for business and professional use — advertising products and services you sell — not for personal or household use.

You must also be authorised to manage every Meta ad account, Facebook Page, Instagram account and Pixel you connect.

03Your account

  • Give us accurate information and keep it up to date.
  • Keep your password secure. You’re responsible for everything that happens under your account, so tell us straight away at support@flyroas.com if you suspect unauthorised access.
  • Each login is for one person. Share access only through the seats your plan includes.

04The Service

Fly ROAS AI is an AI media buyer for Meta advertising on Facebook and Instagram. Depending on your plan, it lets you:

  • extract your Brand DNA — colours, fonts, logo, voice, products and prices — from the website you provide,
  • study competitors’ long-running ads in the public Meta Ad Library to learn their structure, hooks and layouts,
  • generate image and video ads from your own product photos using AI models,
  • launch ads to your own Meta ad account in one click, created paused until you approve them, and
  • optionally run Autopilot, which judges tests, stops losers, scales winners and creates fresh variants within the rules you set.

We keep improving the Service and may add, change or remove features. If we remove a feature that’s material to your paid plan, we’ll tell you in advance. Features marked beta or preview are provided as they are and may change or be withdrawn.

05Your content and responsibilities

You’re responsible for the content you provide and the ads you run. By using the Service, you confirm that:

  • you own, or have every right and permission needed for, the product photos, logos, trademarks, website content and other materials you upload or point us to (“Your Content”), and using them in ads won’t infringe anyone’s rights,
  • your ads, products, landing pages and targeting comply with Meta’s Advertising Standards, Community Standards and Commerce Policies, and with every law that applies to you — including consumer protection, advertising, health and data protection laws,
  • the offers, prices, discounts and claims in your ads are accurate and you can substantiate them. The Service shows prices and offers only after you confirm them, and you remain responsible for checking them before an ad runs, and
  • you are the advertiser of record for every ad launched through the Service.

We don’t review your ads for legal compliance on your behalf. We may refuse to generate or launch content we reasonably believe breaks these Terms, Meta’s policies or the law.

06AI-generated output

  • The Service uses AI models to generate creatives, copy and analysis. AI output can be inaccurate, incomplete or unexpected, and similar output may be generated for other users.
  • Review every creative before it runs — check how your product is shown, the text, prices, claims and any translations.
  • We don’t guarantee that Meta will approve any ad, that ads will deliver, or any particular result — including return on ad spend (ROAS), cost per acquisition, sales or revenue. How an ad performed in the past doesn’t predict how it will perform in future.
  • Competitor research analyses publicly available ads to learn patterns. We don’t copy competitors’ images, copy, logos or brand names into your ads, and you agree not to use the Service to reproduce anyone else’s creative work or trademarks.

07Meta connection and Autopilot authorisation

When you connect Meta, you authorise us to access the ad accounts, Pages, Instagram accounts and Pixels you select, using the permissions described in our Privacy policy, and to act on them as you instruct through the Service.

If you turn on Autopilot, you also authorise us to create, pause, stop and resume ads and ad sets, adjust budgets and launch new variants in your connected ad accounts — always within the monthly cap and daily limit you set, and the launch mode you choose:

  • In “Ask me first” mode (the default), nothing goes live without your approval.
  • If a decision needs you while you’re away, Autopilot waits for your approval. It never launches or scales on silence, while protective steps such as stopping losing ads and keeping spend within your caps continue.
  • You can change your caps, switch modes or pause everything at any time.
  • You can revoke our access at any time in Settings or in your Facebook settings. Autopilot stops acting once access is revoked.

Meta bills your ad spend — not us

Meta charges your ad spend directly to the payment method in your Meta ad account. You remain solely responsible for all ad spend and for any charges, taxes, account restrictions or ad disapprovals from Meta. We never pay Meta on your behalf and aren’t liable for Meta’s charges.

Autopilot never sets budgets above your caps. Because Meta paces delivery and reports results with a delay, actual spend on a given day can differ slightly from the budgets Autopilot sets. What Meta bills is determined by Meta.

08Plans, credits and fees

Plans

Current plans, prices, credit allowances and brand limits are shown on our Pricing page and at checkout. Paid plans are billed monthly or annually in advance. Annual billing is discounted (currently about 20%). Enterprise plans are agreed with our team.

The 14-day test flight

The test flight is a one-off charge (currently $19.99, or ₹1,939 in India) for 14 days that includes 100 credits and one brand. Unless you cancel before it ends, it automatically renews into the Creator plan at the then-current Creator price, billed on a recurring basis.

Automatic renewal

Subscriptions renew automatically at the end of each billing period until you cancel. By subscribing, you authorise us and our payment processors to charge your payment method for each renewal.

Credits

  • Credits are used for AI generation — by default, 2 credits per image ad and 20 credits per video ad. We may change credit costs for future generations with notice.
  • Unused plan credits roll over for one billing cycle, then expire.
  • Credit packs never expire, but they end when your account is closed.
  • Credits have no cash value and can’t be transferred or exchanged for money.

Autopilot

Autopilot is included in your plan, with no charge on the ad spend it manages. New ads that Autopilot drafts for you use credits in the same way as ads you generate yourself.

Taxes and currency

Prices exclude taxes unless stated. You’re responsible for applicable taxes such as GST or VAT, which we add where required. Payments in India are processed in Indian rupees by Razorpay. International payments are processed in US dollars by PayPal. Your bank or PayPal may charge conversion or foreign-transaction fees, which are your responsibility.

Failed payments and price changes

If a payment fails, we may retry it and may limit or suspend paid features until it’s resolved. We may change our prices. We’ll give you reasonable advance notice, and new prices apply from your next renewal after that notice. If you don’t agree, you can cancel before the change takes effect.

09No refunds

All charges are non-refundable — including test flights, subscription periods and credit packs — except for duplicate charges and billing errors, as described in our Refund policy. If a payment is refunded in full for another reason, or reversed through a dispute decided in your favour, the plan or test flight it paid for ends and the unused credits it added are removed, as that policy explains. Nothing in these Terms limits any rights you have under laws that can’t be excluded.

10Cancellation, suspension and termination

  • You can cancel anytime in Billing & credits. Cancelling stops future renewals. Your plan stays active until the end of the period you’ve paid for. To stop a test flight renewing into Creator, cancel before day 14.
  • When your plan ends, Autopilot stops managing your campaigns. Ads still active in your Meta ad account remain under your control and continue to be billed by Meta until you pause or delete them in Meta.
  • We may suspend or terminate your access if you materially breach these Terms, don’t pay, use the Service fraudulently or unlawfully, create risk for us, Meta or others, or if Meta restricts our access. Where appropriate, we’ll give you notice and a chance to fix the problem first.
  • You can delete your account at any time from Settings then Danger zone then Delete account & data. After termination, we delete your data as described in our Privacy policy.

Terms that by their nature should survive termination — including fees owed, intellectual property, disclaimers, limitation of liability, indemnity and governing law — survive it.

11Intellectual property

Your content and your ads

You keep all rights in Your Content. As between you and us, you own the creatives, copy and other output the Service generates for you (“Output”) and may use it for any lawful purpose — subject to these Terms, the terms of the underlying AI model providers and applicable law. In some countries AI-generated material may not be protected by copyright, and we can’t guarantee that Output is unique.

The licence you give us

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and process Your Content and Output solely to provide, secure and support the Service for you — for example, to place your product photos into ads and launch them to your ad account. We never use your brand assets or ad performance to train models for other customers.

Our platform

The Service — including its software, design and the Fly ROAS AI name and logo — belongs to us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use it during your subscription under these Terms. If you send us feedback or suggestions, we may use them without any obligation to you.

12Acceptable use

You agree not to use the Service to:

  • advertise illegal products or services, or anything prohibited by Meta’s Advertising Standards,
  • make false, misleading or unsubstantiated claims — including health, medical or financial claims,
  • infringe anyone’s intellectual property, privacy or publicity rights, or impersonate any person or brand,
  • copy competitors’ creatives, trademarks or brand identity,
  • run discriminatory ads, or target housing, employment, credit or other special ad categories in breach of Meta’s rules or the law,
  • upload malware, or probe, breach or get around our security, rate limits or credit system,
  • scrape, reverse-engineer or copy the Service, or use it to build a competing product,
  • resell or share access beyond the seats your plan includes, unless we’ve agreed in writing, or
  • create content that sexualises minors, or that is hateful, violent, harassing or otherwise unlawful.

13Third-party services

The Service relies on third parties, including Meta’s platforms and APIs, fal.ai for AI inference, and Razorpay and PayPal for payments. Your use of those services is governed by their own terms and policies — for example, Meta’s Terms and Advertising Standards.

We’re not responsible for third-party services, and changes they make — such as Meta changing its APIs, rejecting ads or restricting accounts — can affect the Service. Fly ROAS AI is independent and is not affiliated with, endorsed or sponsored by Meta Platforms, Inc.

14Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement and accuracy. We don’t warrant that the Service will be uninterrupted or error-free, that Output will be accurate or approved by Meta, or that you’ll achieve any particular advertising result. Nothing in the Service is legal, tax or financial advice.

15Limitation of liability

To the fullest extent permitted by law:

  • we aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, sales, goodwill or data, or wasted ad spend, arising out of or related to the Service or these Terms — even if we were told they were possible, and
  • our total liability for all claims relating to the Service or these Terms is limited to the fees you paid us in the three (3) months before the event that gave rise to the claim.

These limits don’t apply to liability that can’t be limited by law, such as liability for fraud.

16Indemnity

You’ll defend, indemnify and hold harmless Fly ROAS AI and its officers, employees and agents against any claims, losses, liabilities and expenses (including reasonable legal fees) arising from Your Content, your ads and products, your use of the Service, your breach of these Terms or Meta’s policies, or your violation of any law or third-party right.

17Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory rights you have where you live, the courts of India have exclusive jurisdiction over any dispute arising from these Terms or the Service.

Before starting formal proceedings, please contact us at support@flyroas.com so we can try to resolve the issue informally.

18Changes to these terms

We may update these Terms from time to time. The date at the top shows the current version. If a change is material, we’ll tell you by email or in the app before it takes effect. If you keep using the Service after that, you accept the updated Terms. If you don’t agree, you can cancel before the change applies.

19General

  • Entire agreement. These Terms, the Privacy policy, the Refund policy and any order form we sign with you are the entire agreement between us about the Service. If you have a signed agreement with us, such as an Enterprise order form, it takes precedence where it conflicts with these Terms.
  • Assignment. You may not transfer these Terms without our consent. We may assign them as part of a merger, acquisition or sale of assets.
  • Severability and waiver. If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a right isn’t a waiver of it.
  • Events beyond our control. We aren’t liable for delays or failures caused by events beyond our reasonable control, including outages or changes at Meta or our other providers.
  • Notices. We send notices to your account email address. You can reach us at support@flyroas.com.
